General Terms and Conditions of Purchase

These General Purchase Conditions regulate the use of the website hellosundayspf.eu (hereinafter "The Website") of which Hello Sunday Ventures, S.L (hereinafter Hello Sunday) is the owner. 
 
Hello Sunday Ventures, SL is a commercial stock company with registered office at C / Ausiàs March, Parc. No 14 CP 46185 Valencia, provided with NIF no. B42903153, registered in the Mercantile Registry of Valencia, volume 10947, Folio 13, Sheet V -196885, 1st Registration, and with email address customer.service@hellosundayspf.com
 
The use by the customer of the services of the online store presupposes, in any case, adherence to the General Conditions of Purchase in the version published at the time of the purchase order. Therefore, it is advisable for the customer to read these General Conditions before proceeding to make a purchase.

1. SCOPE OF THE CONTRACT.
 
These General Purchase Conditions apply to the sale of all Hello Sunday items through its website in the European Union. Hello Sunday informs that its website is exclusively directed to an audience over 18 years of age. Hello Sunday reserves the right to cancel a customer's access account if fraudulent, speculative or bad faith acts are detected in the use of this service.
 
2. PURCHASE LIMIT.
 
For security reasons, purchases over 1000 euros or with more than 100 items per order cannot be made. Those customers who are interested in making purchases for a higher amount should contact Customer Service, where they will be provided with information on how to make the desired purchase.
 
3. PRICE.
 
The applicable prices are those indicated on the website on the date of the order. The prices are detailed in each article and include, where appropriate, applicable taxes, as appropriate. Once the purchase order has been completed, and before making the payment, a final summary will be provided identifying the item / s purchased and their total price (including transport and taxes). The prices on this website are shown in euros.
 
4. PAYMENT.
 
Payment will be made at the end of the purchase process and will be an essential condition for its formalization.
Supported payment methods: Payment can be made with Visa, MasterCard. Shop pay, Google Pay, and Amazon Pay. In any case, the choice of the means of payment is made during the purchase process on the corresponding screen.
 
Hello Sunday uses secure payment systems from leading financial institutions, with the aim of offering maximum security. The client must notify Hello Sunday of any undue or fraudulent charge on the card used for purchases, by email or by phone, in the shortest possible time so that it can take the appropriate steps. Suppliers or issuers of means of payment may adopt anti-fraud measures that lead to the rejection of certain types of operations. Hello Sunday is not responsible for the application of these types of security policies. 
 
You expressly authorize us to issue the invoice electronically, although you may indicate to us at any time your desire to receive a paper invoice, in which case, we will issue and forward the invoice in that format. Hello Sunday will issue an invoice, in the name of the individual or company that places the order, and it will be attached to the purchase confirmation email, once the order has left our warehouses. 


Hello Sunday warns that you will not be able to subsequently modify the sales invoices in compliance with current regulations.
 
5. DELIVERY.
The delivery period will be a maximum of 30 calendar days from the completion of the purchase. The delivery of the orders will be made at the address indicated by the client, taking into account the following characteristics:
 
5.1 Home delivery:
 
1. SPAIN. If the order is equal to or greater than € 35, shipping is free to the Peninsula and the Balearic Islands (if the order is less than the indicated amounts, the cost is 3.95 € for peninsula and 4.95€ for the rest). Delivery takes between 2-5 days.
 
2. REST OF COUNTRIES. If the order is equal to or greater than € 35, shipping is free (if the order is less than the indicated amounts, the cost is € 4.95). Delivery takes between 4-10 days.
 
The address indicated by the client may be a private address, a place of work or any other address indicated. The billing address and shipping address do not have to match. Our transport provider will send an email indicating the day the delivery will be made.
 
5.2 Incidents in delivery:
 
In case of not being able to make the delivery due to the absence of the recipient, the transport agency will try to contact the recipient by phone. After two unsuccessful attempts, the customer must contact the transport agency to proceed with the delivery.
 
6. RETURNS AND WITHDRAWAL.
 
Return: due to a tare, defect or receipt of a wrong product.
 
Withdrawal: originated by the client's decision.
 
6.1 Due to the special characteristics of certain products, the following must be taken into account:
 
(i) For reasons of health and hygiene protection, no return or withdrawal of products is allowed when their wrapping, packaging or seal that protects you, has been opened, except for those that are defective or with defects.
 
(ii) The packs are indivisible and their items cannot be returned separately.
 
6.2 Conditions, reimbursement, costs and procedure:
 
Conditions (Withdrawal): You have 14 calendar days from receipt of the product / s to withdraw from the contract without the need for justification.
 
Conditions (Returns): Hello Sunday will respond to the lack of conformity that is manifested within the period established in the legal regulations.
 
Refund (Withdrawal / Return): Hello Sunday will reimburse, where appropriate, the corresponding amount, including the standard shipping costs of the initial delivery without undue delay and, in any case, before 14 calendar days have elapsed from the date on that has been informed of the return.
The refund will be made by the same means of payment with which it was paid. However, we may retain it until we have received the products, or until you have submitted proof of return, depending on which condition is met first.
 
Costs (Withdrawal): The customer will assume the costs of returning the product or products.
 
Costs (Return): Hello Sunday will be responsible for all the costs of the return, the customer, in addition, will be able to choose between exchanging the product for another in perfect condition or for the correct reference, or for the refund of the product.
 
Procedure: contact Customer Service, via email customer.service@hellosundayspf.com. You must include, completed, the document attached to the shipment (Return and withdrawal form), downloadable here. Once we receive your email, we will process the return, within 2-3 business days.
 
7. AVAILABILITY OF THE PRODUCTS.
 
If there are incidents regarding its supply or if there are no products in stock, the customer will be informed immediately and the amount of the product or products without stock will be reimbursed. Hello Sunday will refund the corresponding amount without undue delay and, in any case, before 14 calendar days have elapsed. The refund will be made in accordance with the provisions of Clause 6.
 
8. GUARANTEE OF THE PRODUCTS PURCHASED.
 
The guarantee offered is the one established in Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users.
 
9. CUSTOMER SERVICE.
 
For any doubt, suggestion, query or claim about the online store, you can contact the Customer Service, by any of the following means:

The Hello Sunday Customer Service will attend and respond to your claim, which will be registered with an identification code, as soon as possible, and in any case within a maximum period of one month. 
 
In the event that your request is not resolved satisfactorily, you may go to the ordinary jurisdiction or process your claim through the website http://ec.europa.eu/odr, which will provide a free single point of access for the extrajudicial resolution.
 
In the event that you detect that an error has occurred when entering your personal data provided during the purchase process, contact customer service through any of the means indicated above. This website shows confirmation windows in various sections of the purchase process that do not allow you to proceed with the order if the data in these sections have not been provided correctly.
 
Likewise, this website offers the details of all the items that you have added to your basket during the purchase process, so that, before making the payment, you can modify the details of your order. If you detect an error in your order after the completion of the payment process, you must immediately contact our customer service, at the aforementioned email address, to correct the error.
 
10. MODIFICATION OF THE GENERAL PURCHASE CONDITIONS.
 
Hello Sunday reserves the right to modify these General Purchase Conditions at any time. No modification will affect orders that are already in progress.
 
11. FORCE MAJEURE.
 
Compliance by Hello Sunday of all or part of its obligations will be suspended in the event of a fortuitous event or force majeure that prevents or delays compliance. They will be considered as such, in particular, without this list being limiting: war, riots, insurrection, social unrest, strikes of any kind and supply problems not attributable to Hello Sunday. 
 
Hello Sunday will inform the client of such a fortuitous event or force majeure within seven days after its occurrence. In the event that said suspension is prolonged beyond a period of fifteen days, the customer will then have the possibility of rescinating the order in progress and will then proceed to reimburse it under the conditions provided in point 6 of these General Conditions. shopping.
 
12. APPLICABLE LAW AND JURIDISCTION.
 
 These General Purchase Conditions are subject to Spanish legislation. Notwithstanding the foregoing, the non-resident consumer in Spain also enjoys the protection guaranteed by the mandatory provisions of the law of the country where they have their habitual residence. 
 
The parties submit, at their choice, for the resolution of conflicts and renouncing any other jurisdiction, to the courts and tribunals of the client's domicile.
